NYSTRS administers a defined benefit plan established by the New York State Legislature. The Legislature must initiate and enact any benefit improvements (e.g., early retirement incentives). NYSTRS' position is neutral; the System has neither the ability to change the benefit structure nor the authority to implement benefit changes.
A bill that alters public pension benefits must be initiated by the State Legislature, approved by both the Assembly and Senate, and signed into law by the governor.
