Employment after retirement for New York State Teachers’ Retirement System retirees has been a topic of concern for this System, the State Education Department (SED), TRS participating employers and the employee organizations our members participate in. We have previously published Administrative Bulletins on this subject, with the most recent being Administrative Bulletin 99-7, sent to you in July 1999.

    Administrative Bulletin 99-7 stated "Retirees of this System may not be employed under Section 211 [of the Retirement and Social Security Law] for a period of six months after retirement." The SED, this System, and the appropriate employee organizations agree this policy applies only to employment with the member's last employer prior to retirement. The SED will continue to review requests for 211 waivers based on the justification of employers' needs in addition to the above policy.

    As previously stated, employment under Section 212 is permitted if it is on a temporary or occasional basis. The earnings limits under Section 212 for retirees was $15,500 in calendar year 1999 and is $17,000 in calendar year 2000.
